Legal Service

You may have received a card from us which says, "Sorry We Missed You"

When we tell people that we have a delivery for them, we often hear them say, "but I haven't ordered anything!" And it's true... some, maybe even most people aren't expecting this.

We are Legal Process Servers

A process server is a person who serves (delivers) court documents upon persons named or involved in a court case. Among other types of documents, it may be a Notice of Civil Claim, documents related to a matter of Family Law, or a Subpoena where you've been called as a witness, among others.

Can't these documents simply be mailed to me?

Unfortunately not. The Court Rules stipulate that these documents, which have already been filed in the Court Registry, need to be served upon you personally. Under normal circumstances you have to receive them in person... from our hand to yours.

What if I refuse to accept them, or just ignore your calls?

The Court Rules require that reasonable efforts are made to serve you these documents. If we are unable to serve them, or you "evade service," then we're required to file documents in the Court Registry, called an Affidavit, attesting to these facts. The law firm which issued the documents then has the option of requesting the presiding Judge issue an Order of Alternative Service in which case the documents may, among other things, simply be posted to the door of your residence or place of business. This can be really embarrassing for you, and we'd rather not have to do this.

Won't it all just go away if you can't reach me?

No, unfortunately not. The legal action in question has already been filed in the Court Registry. It is a legal action which is already underway. Should you evade or refuse service, the matter may eventually proceed without you and a decision may be rendered without your interests being represented.

Frankly, that's not fair to you. That's why it's so important to deliver these documents to you, enabling you to respond in a way which is most fair and beneficial to you and your interests.

What you need to know about Court Orders

There are some cases in which the documents we need to deliver to you contain Orders which have already been issued by the Court. If this is the case, it's imperative that you know what terms of these orders may be, so that you can abide by them. If you contravene a Court Order, you will find yourself in very serious legal trouble, possibly even to the extent of criminal charges. Clearly, no one wants that!

What Will Happen We I'm Served?

Service isn't complicated. One of our Process Servers will ask you to identify yourself. In some cases, you may be requested to provide government issued photo ID to confirm your identity. Once that is done, then the documents are simply handed to you. We've served may people in public places, and to anyone watching it's nothing more than once person handing another person an envelope. That's it. We will make every effort to never embarrass a recipient. Respect and dignity are important to us, too.
